UD-22-04: Resolution and Order Establishing Rulemaking to Consider Savings Target and Program Design for Energy Efficiency, Conservation, Demand Response, and Other Demand-Side Management Programs as well as Cu

Council Docket UD-22-04, established via Resolution R-22-413, is a proceeding opening a docket and establishing a procedural schedule to consider modification of the Energy Smart energy efficiency and conservation program as well as potential Council policy with respect to demand-side management (“DSM”), customer-owned distributed energy resources (“DERs”), and energy storage. 

Pertinent docket deadline dates are/were as follows:

• October 1, 2022 – Deadline for all stakeholders desiring to intervene to file a motion to intervene with the Clerk of Council, with a copy submitted to Bobbie Mason (bfmason1@nola.gov).  Objections to motions to intervene shall be filed within 5 days of such requests. Timely-filed motions to intervene not objected to within that time period shall be deemed GRANTED.
   
• October 31, 2022 – Parties interested in proposing changes to the Council’s energy efficiency, conservation, DSM, kW and kWh savings goals, customer-owned DER, and energy efficiency storage policies should submit their proposals, along with a proposed funding mechanism for those proposals.
   
• November 28, 2022 – December 16, 2022 – Parties shall convene a virtual technical conference to discuss proposals. 
   
• January 12, 2023 – Parties’ responsive comments to proposals due.
   
• March 1, 2023 –  Advisors’ Report due (per Judge Gulin’s January 30, 2023 Order);
   
• March 6, 2023 – March 17, 2023 – A second virtual technical conference of the Parties shall be convened;
   
• March 29, 2023 – Parties comments on the Advisors’ proposed revisions due;
   
• April 17, 2023 – Parties reply comments regarding the Advisors’ proposed revisions due;
   
• April 25, 2023 – Parties may file objections or proposed revisions to: (1) the admission of exhibits; or (2) the language respecting judicial notice, admission into evidence of discovery documents or documents attached to filings (Per Judge Gulin’s April 18, 2023 Order)

• May 2, 2023 – The Hearing Officer shall certify the record and submit it to the Council for final consideration.
   
• December 14, 2023 - Council adopted closing Resolution R-23-553.
