4. Contracts for Recommendation of Approval and Execution per Council Rule 57 – For Discussion and Vote
(a) Amendment No. 5 to the Professional Services Agreement between the City of New Orleans and Sher Garner Cahill Richter Klein & Hilbert, LLC for legal representation in Orleans Parish School Board litigation matter. The amendment extends the term of the agreement for one year (through May 19, 2025), increases the maximum compensation by $17,000 to a total amount not to exceed $431,000 and limits the billable hourly rate.
(b) Amendment No. 5 to the Professional Services Agreement between the City of New Orleans and Stone Pigman Walther Wittmann, LLC for legal representation in Hard Rock Hotel litigation matter. The amendment extends the term of the agreement for one year (through June 30, 2025) and limits the billable hourly rate.
(c) Agreement between the City of New Orleans and Lawyers for Good Government for pro bono legal assistance with accessing the elective pay process and leveraging other tax incentives under the Inflation Reduction Act for eligible energy investments. The agreement is for a term of two years, and there are no fees for these professional services.
5. Non-Commercial Short Term Rental Matters – For Discussion and Vote
(a) Motion No. M-24-492 – By: Councilmembers Morrell, Giarrusso, Harris, King, Green and Thomas. Directing City Planning Commission to conduct a public hearing to consider amendments to Ordinance No. 4264 M.C.S., as amended, the Comprehensive Zoning Ordinance, to amend Article 21, On-Site Development Standards, at 21.8.C.18.R, to remove special exceptions from block limitations.
(b)(i) Motion No. M-24-493 – By: Councilmembers Morrell, Moreno, Giarrusso, Harris, King, Green and Thomas. Directing City Planning Commission to conduct a public hearing to amend and reordain Ordinance No. 4264 M.C.S., as amended, the Comprehensive Zoning Ordinance, to amend Article 19 to establish a new Interim Zoning District to be named the Non-Commercial Short-Term Rental Special Exception Interim Zoning District (IZD), the intent of which is to prohibit the issuance of any Non-Commercial Short Term Rental by special exception as specified in Section 21.8.C.18.R.
(b)(ii) Amendment to Motion No. M-24-493 – By: Councilmember Morrell. Clarifying effective dates on the Non-Commercial Short-Term Rental Special Exception Interim Zoning District.
(c) Ord. Cal. No. 34,806 – By: Councilmember Morrell. An Ordinance to amend and reordain sections 26-614, 26-615, 26-616, 26-622, 26-623, and 26-624 of the Code of the City of New Orleans to require short-term rental platforms to verify the legal eligibility of a short-term rental through an electronic verification system before completing a booking transaction for the short-term rental; and otherwise to provide with respect thereto.
6. Ord. Cal. No. 34,815 – By: Councilmember Morrell – For Discussion and Vote. An Ordinance to establish section 70-12 of the Code of the City of New Orleans relative to a requirement that private developments provide a fund match for any allocation of public dollars pursuant to a cooperative endeavor agreement; and otherwise to provide with respect thereto.
7. Motion No. M-24-499 —By: Councilmembers Moreno, Morrell, Giarrusso, Harris, King, Green, and Thomas – For Discussion and Vote. Requesting the New Orleans Health Department investigate and study any delay of care issues related to the classification of Mifepristone and Misoprostol as dangerous Schedule IV controlled substances and to establish, as needed, a complaint-based reporting system to allow patients, health care providers, pharmacists, and other stakeholders to report challenges with accessing Mifepristone or Misoprostol for medically necessary and legal uses in New Orleans.
