District "C" Councilmember Kristin Gisleson Palmer Releases Details on Short Term Rental Ordinances Scheduled for a Vote by the Council This Week

NEW ORLEANS - At its regular meeting on Thursday, August 8, the Council will consider three ordinances that would amend the City's Short-Term Rental (STR) regulations, fines and fees. Ordinance No. 32,685 by District "C" Councilmember Kristin Gisleson Palmer modifies the City's Comprehensive Zoning Ordinance (CZO) to establish two categories of STRs: Residential and Commercial. 

Ordinance No. 32,691 by Councilmembers Gisleson Palmer, Helena Moreno and Jay H. Banks, establishes STR owner, operator and platform permits and fees, operating regulations and enforcement penalties. A third ordinance (Ordinance Cal. No. 32,708) by Councilmember Helena Moreno defines STR platforms and others who collect payments as "dealers" subjecting them to City tax collection. Councilmember Palmer has included a brief description of the ordinances and fact sheets to help residents understand the legislation in advance of the Council's vote.

STR Ordinances on August 8 Council Meeting Agenda:

  • 1. Ord. Cal. No. 32,685 - CZO STR Policies
    • A) Amends STR policies in the CZO, in accordance with Council Motions M-19-204 and M-19-205 approved at the May 16, 2019, Council meeting. M-19-204 establishes two classifications of STR permits, Residential and Commercial, along with zoning regulations for each. M-19-205 bans STRs in the French Quarter (except for Bourbon Street) and Garden District. Fact sheet here explaining the STR proposed changes. 
  • 2. Ord. Cal. No. 32,691 - Code STR Policies
    • A) Amends the Municipal Code (Article XI of Chapter 26), aligning it with forthcoming CZO policies and establishing new application, operating, and enforcement procedures.  Fact sheet here explaining permitting and enforcement proposed changes. 
  • 3. Ord. Cal. No. 32,708 - Code Tax Policies
    • A) Amends the Municipal Code (Article VI of Chapter 150), defining STR platforms and others who collect STR payments as "dealers," subjecting them to City tax collection and remission requirements.
