    UD-24-01: Resolution and Order Establishing a Period of Intervention and Other Procedural Requirements for the Consideration of the Delta State Utilities NO, LLC and Entergy New Orleans, LLC to Operate as a Jur

    Council Docket UD-24-01, established via Resolution R-24-49, initiated proceedings to establish a procedural schedule to consider Delta States Utilities NO, LLC (“DSU”) and Entergy New Orleans’ (“ENO”) joint application for DSU to (i) operate as a jurisdictional natural gas local distribution company; (ii) approve the transfer and sale of ENO’s jurisdictional gas distribution business and acquisition to DSU; (iii) approve DSU’s assumption and adoption of ENO’s existing rates, rate schedules, and riders; (iv) approve for DSU’s creation of regulatory asset(s) to defer for future recovery, subject to Council approval; (v) determine that the costs of purchased assets not yet in service, but currently categorized by ENO as construction work in progress do not constitute acquisition premium, such that costs may be eligible for recovery in rates once placed in service; (vi) approve ENO’s transfer of certain customer data; and (vii) find that appropriate Council ratemaking resolutions, orders, and ordinances continue to be applicable to DSU.

    Pertinent docket deadline dates are/were as follows:

    • February 22, 2024 – Commencement of formal discovery upon full Council adoption of initiating Resolution R-24-49 through 8 calendar days prior to the date of the Evidentiary Hearing or August 31, 2024; 
       
    • March 25, 2024 – Parties may intervene in the docket by filing a Motion to Intervene with the Clerk of Council, an electronic copy addressed to Mr. Byron Minor at email: Byron.Minor@nola.gov, and paying the applicable filing fee, unless such fee is waived pursuant to Council Resolution R-16-365.  Timely filed motions to intervene that are not opposed within the allotted time-period shall be deemed granted; 
       
    • April 19, 2024 – Direct Testimony of Intervenors due; 
       
    • May 10, 2024 – Direct Testimony of Advisors due; 
       
    • June 7, 2024 – Intervenor Cross-Answering Testimony due; 
       
    • June 28, 2024 – Rebuttal Testimony of ENO and DSU due; 
       
    • July 19, 2024 – Surrebuttal Testimony of Intervenors and the Advisors due; 
       
    • August 9, 2024 – Rejoinder Testimony of ENO due; 
       
    • September 9-11, 2024 – Evidentiary Hearing shall be conducted; 
       
    • September 30, 2024 – Hearing Officer to certify the record of these proceedings; 
       
    • October 15, 2024 – Initial briefs shall be filed; 
       
    • November 1, 2024 – Reply briefs shall be filed.
