    UD-18-04: Whole Building Data Energy Usage Collection

    Council Docket UD-18-04, established via Resolution No. R-18-225, is a rulemaking proceeding to revise the Council’s rules to allow the release of whole-building energy usage data.  The Mayor’s Office of Resiliency and Sustainability (“ORS”) sought to obtain the release of whole-building energy usage data for buildings with four or more tenants to building owners without the need to first obtain authorization from tenants for the purpose of establishing energy benchmarks for these buildings. The usage data would be used to identify appropriate energy efficiency measures and to further the Council’s goal of increasing the deployment of energy efficiency measures. 

    On December 20, 2018, via Resolution R-18-539, the Council agreed to allow revisions to the Council’s Customer Service Regulations to permit the release of aggregated whole-building data to building owners under certain specified conditions, and require ENO to provide such data to building owners or their designated representatives upon request pursuant to a Council-approved process once advanced metering infrastructure (“AMI”) has been fully deployed within the Entergy New Orleans (“ENO”) system.  In addition, the Council authorized ENO to proceed with the option to build internal software to aggregate the data and transmit it to the Portfolio Manager at an anticipated cost of $25,000 plus labor.

    On May 23, 2019, the City Council adopted Resolution R-19-206 resulting in settlement of Docket UD-18-04.

    Pertinent docket deadline dates were as follows: 

    • July 20, 2018 – All interested persons that wished to intervene in this docket were required to file motions to intervene with the Clerk of Council no later than July, 20, 2018; 
       
    • July 25, 2018 - Any objections to intervention requests due; 
       
    • August 24, 2018 – All comments from parties regarding proposals to amend Council’s Customer Service Regulations due; 
       
    • September 14, 2018 - All reply comments due; 
       
    • October 19, 2018 – Council Advisors’ Report due; 
       
    • January 21, 2019 – Intervenors required to provide the following in order to assist ENO and the Council in ascertaining the potential costs and benefits of requiring ENO to respond to such requests: 
       

    o   Information regarding the number and size of buildings that they would like  included as part of an interim solution allowing the release of whole-building data before the full implementation of AMI on ENO’s system; and; 

    o   The estimated dollar value of the benefits to ratepayers. 

    • February 18, 2019 – ENO required to file for Council review and approval: 
       

    (a) Draft processes for the release of whole-building data; and

    (b) Further information regarding the costs and benefits anticipated to ratepayers of releasing aggregated whole-building data upon request to a limited number of building owners prior to the full implementation of AMI on the system; 

    • February 18, 2019 – Deadline for the Advisors conduct two more teleconferences among the parties to discuss possible interim solutions; 
       
    • April 10, 2019 – Deadline for any party to file a proposed interim solution for the Council’s review and consideration. Any party may file comments on such proposal within 30 days of the filing of a proposed interim solution, and reply comments may be filed by any party within 30 days of the filing of comments. 
       
    • May 23, 2019 - The City Council adopted Resolution R-19-206 resulting in settlement of Docket UD-18-04.
